The principle of legality in Australia and New Zealand( Book )

1 edition published in 2017 in English and held by 55 WorldCat member libraries worldwide

The principle of legality is now central to the operation of Australian and New Zealand public law. Yet its content, methodology and scope remain elusive and has never been examined in detail. This book fills that gap by drawing together leading judges, practitioners and scholars to explore a range of interesting issues and challenges for the application of the principle of legality and its future trajectory: How does the principle operate? Which rights and freedoms fall within its scope and why? What is its relationship to the (so-called) common law bill of rights? Has proportionality a role to play in its application? How, if at all, does it differ from the presumption with international law? And in the construction of statutes does the principle serve to fulfil or frustrate the will of Parliament?

Présentation de l'éditeur : "This book draws on the many similarities between the Indian and Australian legal systems, while highlighting the vast differences in legal practice. It provides a comparative analysis of a broad range of legal subjects, authored by some of Australia`s and India`s top legal luminaries. This volume compares many of the significant areas of the respective regulatory regimes to allow the reader to understand the similarities and differences of the legal frameworks. The first section discusses the respective regulatory frameworks from a macro perspective, comparing constitutional laws, approaches to judicial interpretation and international trade and investment policies. The second section is of particular relevance to businesspeople and transactional lawyers, focusing on how mergers and acquisitions, capital markets and securities, competition law, tax and intellectual property are regulated. The third section discusses both jurisdictions` approach to dispute resolution and the fourth section of this volume focuses on environmental law, public health law, the regulation of energy and resources and corporate governance. This volume will be a useful resource for businesspeople, academics, law students, corporate lawyers and policy makers interested in India, Australia or the Australia-India relationship."

From dialogue to disagreement in comparative rights constitutionalism by Scott Stephenson( Book )

1 edition published in 2016 in English and held by 4 WorldCat member libraries worldwide

"The bills of rights adopted in the Commonwealth countries of Canada, New Zealand, the United Kingdom and, at the subnational level, Australia in recent decades, have prompted scholars and institutional actors involved in the process of constitutional design and reform to rethink how to evaluate and compare the different approaches to human rights protection. They have challenged a number of assumptions in the field, for example, that courts must have the power to invalidate laws that are found to violate rights (i.e. courts can now be given non-binding powers), that courts must have the 'final word' on rights issues (i.e. legislatures can now be given the power to override judicial decisions) and that bills of rights are enforced exclusively by courts (i.e. legislators can now be given new responsibilities to ensure that the laws they enact are compatible with rights). This book addresses three questions arising from these developments. How do these new bills of rights differ from the traditional approaches to rights protection? Why, if at all, should we consider the Commonwealth's approach over the traditional approaches? What compromises must be struck in the course of adopting a bill of rights of this variety? In answering these questions, the book sets out a new framework for comparison that focuses on the types of inter-institutional disagreement facilitated by and found in the different approaches to rights protection. It also identifies a previously unrecognised element of the Commonwealth's approach - the normative trade-offs with other constitutional principles and values - that is pivotal to understanding its operation. Finally, it seeks to contribute to future debates about rights reform in Australia and elsewhere by setting out a number of lessons that emerge from the answers to these three questions."--
