Among the prominent legal roles Claus-Dieter Ehlermann has played in his career, his leadership of the Legal Service of the European Commission is perhaps the best known. In this book 30 of his colleagues offer fresh and provocative insights into many of the areas of international law on which Professor Dr Ehlermann has left his stamp. Topics include: the WTO dispute settlement system; regulation of trade barriers; the first signs of a global jurisprudence; the principle of proportionality; enforcement of competition law; and the place of human rights in European and global integration. This article discusses the momentous change set out in the White Paper on Modernising EC Antitrust Policy. For forty years the Commission has been the only authority able to grant exemptions to Article 81(3). The White Paper would make Article 81(3) directly effective, eliminating the need for any administrative anti-trust authorities, and thus avoiding the need for any transfer of responsibility to authorities in the Member States. This is examined against the background of the existing administrative system. Problems that may be raised by the proposed new procedure are also considered.--SCAD summary

In an intense, intimate environment, this group of experts debated a number of legal and economic issues pertaining to two broad lines of discussion: 1) settlements and plea agreements in cartel cases, including their links with leniency programs and with private enforcement; and 2) settlements in 'commitment' cases decided under Article 9 of Regulation 1/2003 and under comparable procedures of national law
