Attorneys make oral arguments before the U.S. Supreme Court in the cases of Rasul v. Bush and Al Odah v. United States. The two cases were consolidated into one hour of oral argument. The cases focus on writs of habeas corpus for foreign nationals deemed enemy combatants who were captured abroad by the U.S. military and incarcerated indefinitely at Guantanomo Bay Naval Base in Cuba without access to the legal system. Gibbons argues that even suspected terrorists deserve access to the courts. Olson argues that American courts have no authority to second-guess the status of foreign aliens held outside the borders of the United States.
