"Since 1947, Stephen M. Schwebel has written some 200 articles and book reviews on topics of international law, international arbitration and international relations. This volume brings together thirty-two of the legal articles and commentaries written since the first volume of his essays was published in 1994. The essays analyze contentious issues of international arbitration and international law such as the place of preparatory work in interpreting treaties, the role of a judge of the nationality of a party to a case sitting in judgment in the International Court of Justice, and the meaning of the term 'investment' in ICSID jurisprudence. Together with his unofficial writings, his judicial opinions are catalogued in the list of publications with which this volume concludes"--Provided by publisher

The most comprehensive and up-to-date analysis of stability in long-term energy contracts between investors and States yet undertaken An in-depth analysis of the guarantees provided by investment treaty law (BITs, NAFTA and the Energy Charter Treaty) in enhancing contract stability in this vital economic sector (FET, the umbrella clause, legitimate expectations) An exhaustive review of all known arbitration cases that concern direct and indirect expropriation in the energy sector in recent years, with particular emphasis on taxation issues and environmental aspects Two highly detailed case studies of energy disputes in Latin American and Central/East European regions (including Venezuela, Russia and Kazakhstan) At a time of unprecedented growth in arbitrations between investors and States over energy resources, International Energy Investment Law: The Pursuit of Stability examines and assesses the variety of contract- and treaty-based instruments in commercial and international law that strive to protect the respective interests of investors and States in the international energy industry. It covers most forms of energy, especially oil and gas, and considers issues arising from energy network operation including transit. It pays particular attention to their practical impact through an analysis of their enforcement by arbitration tribunals and bodies, such as the ICSID, the ICC and the LCIA. The book also examines growing challenges presented by environmental and human rights concerns to the stability of long-term agreements. Investors in the international energy industry have long sought to secure guarantees from host States to mitigate the risk of unilateral revision of the deal at a future date. In recent years the traditional method of securing such guarantees has been supplemented by an unprecedented growth of international investment law in the form of BITs, MITs and other treaty-based instruments

The impact of the International Court of Justice by Stephen M Schwebel( )

5 editions published between 1998 and 2000 in English and held by 7 WorldCat member libraries worldwide

This paper addresses the following questions: What has been the impact of the World Court in the fifty years of its existence? How, other than in terms of purely legal analysis, should we attempt to assess its effectiveness? Is it a meaningful factor in world affairs? The analysis also highlights that there are not many points of comparison between the International Court of Justice and other judicial bodies. It concludes that although the Court is not a great player on the world stage, its role is positive and significant in view of the incremental nature of the processes of promotion of peace and progress.--ECLAS summary

Human Rights in the World Court by Stephen M Schwebel( )

3 editions published in 1991 in English and held by 5 WorldCat member libraries worldwide

In this article, the author reviews the cases of the International Court of Justice that have substantial human rights implications. He observes that while the Court is not a human rights court since its judgments are limited to States, it has nevertheless constructively dealt with important issues of human rights. The Court has proscribed the imposition of criminal liability by analogy; it has emphasised the immoral and illegal character of genocide; it has stated that apartheid violates human rights; and that the provisions of the United Nations Charter impose binding human rights obligations upon States. The author concludes that the Court should remain an important actor in this field.--SCAD summary
