Justifying intellectual property by Robert P Merges ( )
10 editions published in 2011 in English and Undetermined and held by 1,438 WorldCat member libraries worldwide
Why should a property interest exist in an intangible item? In recent years, arguments over intellectual property have often divided proponents - who emphasize the importance of providing incentives for producers of creative works - from skeptics who emphasize the need for free and open access to knowledge. In a wide-ranging and ambitious analysis, Robert P. Merges establishes a sophisticated rationale for the most vital form of modern property: IP rights. His insightful new book answers the many critics who contend that these rights are inefficient, unfair, and theoretically incoherent. But Merges' vigorous defense of IP is also a call for appropriate legal constraints and boundaries: IP rights are real, but they come with real limits. Drawing on Kant, Locke, and Rawls as well as contemporary scholars, Merges crafts an original theory to explain why IP rights make sense as a reward for effort and as a way to encourage individuals to strive. He also provides a novel explanation of why awarding IP rights to creative people is fair for everyone else in society, by contributing to a just distribution of resources. Merges argues convincingly that IP rights are based on a solid ethical foundation, and - when subject to fair limits - these rights are an indispensable part of a well-functioning society

Outer space : problems of law and policy by Glenn H Reynolds ( Book )
13 editions published between 1989 and 1998 in English and held by 536 WorldCat member libraries worldwide
This second edition takes account of the important changes that have swept the field since the end of the Cold War, including rapid growth and change in commercial space-launch services, increasingly important issues of international trade in space-related goods and services, the expansion of space-based communications services, and the move to rethink -and perhaps rewrite- the Moon Treaty. Extensive excperts from major works in the field provide a sense of the many different interests and schools of thought that are shaping space policy- from the "New International Economic Order" writers of the Third World, whose theories were embodied in the Moon Treaty, to the free enterprise space capitalists of the United States, who have managed to create and American commercial space-launch industry. The text provides penetrating original insights into current problems such as unfair trade in satellite launch services and ballistic missile proliferation and considers such future areas of conflict as allocation of space resources. "Outer space: problems of law and policy" is ideal both as a text in space law and as an educational tool for interested practitioners and nonlawyers alike, students of international affairs will find it useful as a case study in the impact of changing technologies on disputes over resources and power

The control of strategic alliances : an empirical analysis of biotechnology collaborations by Joshua Lerner ( Book )
12 editions published in 1997 in English and held by 77 WorldCat member libraries worldwide
Abstract: In this paper, we examine the determinants of control rights in technology strategic alliances between biotechnology firms and pharmaceutical corporations, as well as with other biotechnology firms. We undertake three clinical studies and an empirical analysis of 200 contracts. Consistent with the framework developed by Aghion and Tirole [1994], the allocation of control rights to the smaller party increases with its financial health. The empirical evidence regarding the relationship between control rights and the stage of the project at the time the contract is signed is less consistent with theoretical frameworks
