Biopiraterie, transfert d'ADN entre chercheurs, brevets sur les gènes, blocages de la recherche : derrière ces phénomènes se pose une question cruciale, celle du partage des ressources biologiques. Les acteurs sont des plus divers (peuples autochtones, patients, chercheurs, industriels, États), les enjeux éminemment complexes (équité, éthique, recherche, marché), qui contraignent à jeter les bases d'une "bio-équité", clé du partage des ressources biologiques. Avec l'avènement des biotechnologies, les ressources biologiques sont devenues une richesse plus convoitée que jamais : toute plante, tout micro-organisme, tout tissu humain recèle des potentialités pour la recherche et la mise au point de nouveaux médicaments ou autres produits cosmétiques ou agro-alimentaires susceptibles de générer du profit. Or qui peut légitimement revendiquer des droits sur cette manne potentielle ? Les développeurs de médicaments brevetés ? Les chercheurs qui ont contribué à les mettre au point ? Ceux (pays en développement, patients) qui ont fourni la ressource biologique à l'origine du produit ? Plus en amont, puisque les ressources biologiques ont désormais acquis une valeur et un intérêt médical sans précédent, comment s'assurer qu'elles ne seront pas accaparées par quelques uns au préjudice de l'intérêt général ? Faut-il ériger les ressources biologiques en "bien commun" ? Croisant les points de vue des meilleurs spécialistes et proposant une lecture accessible à tous (encadrés, interviews, index etc.), cet ouvrage propose de jeter les bases d'une indispensable "bio-équité". Il s'agit de rien moins que d'organiser une gouvernance acceptable du vivant, entre marché et équité, propriété exclusive et accès, innovation et justice Nord-Sud

IS IT POSSIBLE TO BASE A LEGAL CONSTRUCTION FOR GENETIC HUMAN RESOURCES ON LEGAL CONCEPTS OF PATRIMONY, EVEN THOUGH THE LAW OF 29 JULY 1994, WHICH INCORPORATES THE HUMAN BODY INTO THE CIVIL CODE, EXPRESSLY DECLARES THAT NEITHER THE BODY NOR ITS PARTS CAN BE THE SUBJECT OF A PROPERTY RIGHT? THIS THESIS ADRESSES THIS PARADOX IN THREE PARTS. THE FIRST PART SURVEYS EXISTING CARACTERISATIONS OF INDIVIDUAL AND COLLECTIVE GENETIC INHERITANCE, IN LEGISLATION, CASE-LAW AND SCHOLARLY WRITINGS. FROM EXCLUSION OF OWNERSHIP TO EXCLUSIVISM, THESE CARACTERISATIONS OF THE GENOME ARE FULL OF CONTRADICTIONS, OF WHICH THE EMBRYO IS PARADIGMATIC. THAT IS WHY IT IS URGENT TO OVERRIDE THE SUMMA DIVISIO BETWEEN THINGS AND PERSONS AND WHY THE NOTION OF PATRIMONY MAY BE FRUCTUL, SINCE IT IS THE EXTENSION OF LEGAL PERSONALITY IN THE REALM OF THINGS. THE SECOND PART OF THE THESIS CONSISTS IN AN ANALYSIS OF THE TWO MAIN THEORIES OF PATRIMONY, ON THE ONE HAND AUBRY AND RAU'S CONCEPTION (THE PATRIMONY AS COROLLARY OF LEGAL PERSONALITY), ON THE OTHER HAND THE GERMAN THEORY DEVELOPED BY BRINZ (THE PATRIMONY IS CONSTITUTED BY ITS AIM), BOTH OF WHICH MAY BE EXPLOITED FROM A MODERN PERSPECTIVE. IT THUS BECOMES POSSIBLE, IN THE THIRD PART, TO PUT FORWARD SOME ELEMENTS FOR CONSTRUCTING A SET OF LEGAL RULES FOR GENETIC RESOURCES. THE NOTION OF INALIENABILITY SEEMS ESSENTIAL BECAUSE IT IS THE ONLY ONE WHICH CAN LOGICALLY STRUCTURE THE TRANSACTIONS SPHERE OF WHICH THE BODY FORMS A PART. IN CONTRAST, THE CONCEPT OF TRANSMISSION IS MUCH TOO VAGUE TO BE REALLY RELEVANT IN THIS FIELD, EXCEPT THROUGH TECHNIQUES SUCH AS THE CHARITABLE TRUST WHICH MAY PROVIDE A PRAGMATIC FRAMEWORK FOR ORGANISING RESEARCH OF THE GENOME. FINALLY IT IS POSSIBLE TO GIVE AN AFFIRMATIVE ANSWER TO THE INITIAL QUESTION WHILE BEING AWARE OF THE NEED TO GIVE FURTHER THOUGHT TO THE CONCEPTS OF IDENTITY AND ORIGIN

Fifty years after Mali got independence, the legislator is still looking for a Family Code. The French legislator had tried before him during the colonial times, without much success. They both in turn have had to answer the question of which place to give to the customary or religious rules in the laws concerning family. There's actually a strong opposition in Mali between those who think that the legislator should subordinate the family laws to the customary or religious rules and those on the contrary who think that the legislator should submit the customary or religious rules to the laws. At stake is nothing less than the emancipation of Malian women. Subordinating the laws to the customary or religious rules or choosing the other way around leads indeed to very different consequences: in the first hypothesis, women will be under the guardianship of customary or religious rules ; in the second one, women will be freed from this corpus. What is the right solution to emancipate Malian women? In order to find it, this work begins with an analysis of the existing rules concerning family and shows that they put the Malian women under a heavy burden. It also interrogates what should happen and builds up some propositions leading to the emancipation of women : those propositions are related to different paradigms like constitutionalisation, internationalisation, fundamental rights, judicial dialogue
