Spijkerboer laat op minutieuze wijze zien dat de Afdeling keuzes maakt waartoe zij niet door wet- en regelgeving of eerdere jurisprudentie wordt gedwongen. Wat doet de Afdeling met die keuzevrijheid? Gaat zij daar anders mee om dan Nederlandse vreemdelingenrechters in het verleden? Net als veel andere rechters ontkent de Afdeling haar keuzevrijheid tot op zekere hoogte. Wat voor gevolgen heeft het dat deze keuzevrijheid bestaat en gebruikt wordt, maar tegelijkertijd wordt ontkend? Spijkerboer betoogt dat de Afdeling een speelveld heeft geschapen dat in procedureel opzicht in het voordeel van de overheid werkt. Zij heeft bescherming tegen onmenselijke behandeling (asiel), bescherming van gezinsleven (gezinshereniging) en vrijheid (vreemdelingendetentie) veranderd van een subjectief recht van de vreemdeling in een discretionaire bevoegdheid van de staatssecretaris
