Speaking to reporters from the Cross Halls area of the White House, President Bush announced the nomination of Judge Samuel Alito to replace Justice O'Connor on the U.S. Supreme Court. In his remarks President Bush talked about Judge Alito's qualifications and experience on the federal bench. Judge Alito thanked the president for his confidence and said that he was honored to be nominated. He also thanked members of his family in attendance as well as his parents. Judge Alito was nominated after White House Counsel Harriet Miers withdrew her name from consideration amid several questions about her qualifications for appointment and the refusal of White House staff to release records of her work in the counsel's office

Among the issues addressed were precedents for using military commissions and tribunals, whether a state of war existed under which war crimes could be tried, and habeas corpus. Sà„lim Ahmed Ramdan, a Yemen native, served as the driver and aide to Osama bin Laden until he was captured in Afghanistan and subsequently detained at the U.S. naval base at Guantanamo Bay, Cuba. He filed a petition of habeas corpus to challenge his confinement. In July 2005 the U.S. Court of Appeals for the District of Columbia ruled against Hamdan, saying Congress had authorized the president to set up special tribunals
