Abstract:

"Since the Librarian of Congress is the head of an agency in the legislative branch and not an employee thereof, the present statutory exclusion does not apply to him, and he is not subject to exclusion by Executive order. A decision of the Comptroller General, issued at the request of the Assistant Librarian of Congress, involving a related personnel matter, held that the Librarian of Congress is the head of an agency for purposes of pay administration (B-120604, August 30, 1976). Thus, we have the necessity for these hearings"--Page 1.
