Abstract:

The Governor is the chief executive of the state whose function is to administer the laws of the state. One of the activities used to accomplish this function is researching legal issues and precedents to assist the Governor and his/her legal staff in making decisions regarding litigation in which the state of Alabama is involved.

This series consists of legal documents, correspondence, memoranda, reports, publications, and newspaper clippings that were maintained as a subject file by the governor's legal advisors. The bulk of the material was directed to or used by Hugh Maddox; however, the files also contain material maintained by William M. Nettles and Richard L. Holmes. Maddox served as legal advisor to Governors George C. and Lurleen B. Wallace and Albert Brewer. Nettles began his career at the end of George Wallace's first term, worked for Governor Lurleen Wallace, and eventually became Governor Albert Brewer's administrative assistant. Holmes replaced Maddox as Brewer's legal advisor.

This series reflects the subjects and issues that were of top priority to the governor. Civil rights court cases, primarily dealing with school integration, are featured prominently among the records. Among the most notable legal suits documented are: Anthony Lee vs. Macon County Board of Education, Lurleen B. Wallace vs. United State of America, and Alabama NAACP State Conference Branches vs. George C. Wallace. There is considerable material pertaining to the Wallaces' legal battles in response to the U.S. Department of Health, Education, and Welfare (HEW) mandate that welfare and education funding would be cut if Alabama did not comply with the Civil Rights Act of 1964. Among the individuals who are featured prominently in the records of these cases are: HEW Secretary John W. Gardner; U.S. Commissioner of Education Harold Howe, II; Lawrence E. Crowder, Civil Rights Specialist with the U.S. Office of Education; Montgomery, Alabama, attorney Fred D. Gray; Macon, Georgia, attorney Charles J. Bloch; and Jackson, Mississippi, attorney John C. Satterfield.

Extensive files were maintained on school systems throughout the state. These files contain statistical reports and other information regarding the racial composition of the schools and the procedures by which integration was or was not achieved. The records also document litigation regarding the purchase of state textbooks.
