During the spring of 1931 a grand jury indicted Alphonse Capone on an attempt to evade the income tax and on June 16, 1931, he was arraigned before Federal Judge James H. Wilkerson of the District Court of the United States for the Northern District of Illinois. The trial was finally set for October 1931. A verdict of guilty was returned and a sentence in the penitentiary was imposed. The case was appealed to the Circuit Court of Appeals for the 7th circuit, where the ruling of the Lower Court was upheld, and the U.S. Supreme Court later denied a writ of certiorari.
