"The turmoil in financial markets that resulted from the 2007 subprime mortgage crisis in the United States indicates the need to dramatically transform regulation and supervision of financial institutions. Would these institutions have been sounder in the 2004 Revised Framework on International Convergence of Capital Measurement and Capital Standards (Basel II accord) - negotiated between 1999 and 2004 - had already been fully implemented? Basel II represents a dramatic change in capital regulation of large banks in the countries represented on the Basel Committee on Banking Supervision. This study evaluates Basel II as a bank regulatory paradigm and as an international arrangement, considers some possible alternatives, and recommends significant changes in the arrangement."--Jacket

This article reviews the current impasse in international competition policy and the proposal of the European Commission that the member states of the World Trade Organisation should negotiate a binding competition code. The United States' rejection of this idea and the capacities of international organisations such as the World Trade Organisation and the Organisation for Economic Co-operation and Development to provide an adequate forum for the resolution of these issues is reviewed. Problems include anticompetitive conduct which eludes national regulation, conflicts between nations arising from antitrust reinforcement, burdens of conflicting enforcement policies, and market access. International institutions are described and it is concluded that the idea of pursuing antitrust principles through a WTO code is at odds with the world trading system.--SCAD summary

This paper first identifies the nature and relative seriousness of the four problems in the field of international competition policy, i.e. increasing transnational anti-competitive activity outside control of any single nation; enforcement conflicts; market access problems; and unnecessary costs of compliance with multiple national regimes. The analysis shows that each of these problems appears real but of limited scope and urgency, although each shows the potential to become more important over time. It is then argued that a competition code in the WTO would address these problems imperfectly or not at all. The conclusion shows that the best approach is to pursue a mix of bilateral, OECD, and WTO initiatives, which places protection of consumers from anti-competitive activities at the centre of international efforts.--SCAD summary
