Revisiting the philosophical foundations of trademarks in the US and UK by Mohammad Amin Naser( file )
1 edition published in 2010 in English and held by 0 libraries worldwide
"This book challenges the philosophical foundations of the current trademark systems in the USA and the UK. It argues that the process of trademark creation should be transformed to the more practical and realistic proposition of 'co-authorship' of trademarks by both the public and trademark owners. The book develops the 'economic-social planning justification' which departs from the economic argument that trademarks reduce consumer search costs, and then proposes that trademarks should be formulated in a manner which helps foster a just and attractive culture. Trademarks are seen as source and origin identifiers, rather than quality identifiers. The book focuses on the often ignored role of the public and their rights in trademarks and calls for the adoption of the confusion rationale for trademark protection, not the dilution individualistic rationale. The two jurisdictions of this book prove adverse effects over the rights of the public in terms of using trademarks in cultural and expressive contexts, thereby threatening the principles of freedom of expression as a human fundamental right"--Provided by publisher
Immunities and the right of access to court under Article 6 of the European Convention on Human Rights by Matthias Kloth( file )
1 edition published in 2010 in English and held by 0 libraries worldwide
The conflict between immunities and the right of access to court under Article 6 of the European Convention on Human Rights remains one of the most interesting problems in the current Strasbourg jurisprudence. The European Court of Human Rights had to rule repeatedly on interferences with the right of access by State immunity or the immunity of international organisations. It is here that human rights law and public international law are directly conflicting with each other. "Domestic immunities"of Members of Parliament, judges, the police or the social services have likewise conflicted with the Convention. This book is the first comprehensive work which covers all kinds of immunities and which discusses the entire case-law of the European Court of Human Rights on the matter

Theodor Seuss Geisel by Donald E Pease( file )
1 edition published in 2010 in English and held by 0 libraries worldwide
Dr. Seuss's infectious rhymes, his blue-tufted, strong-willed creatures, and his knack for pithy, roundabout plots have been entertaining children and adults for decades. And as the biographer shows, the seemingly haphazard trajectory of Theodor Geisel's life bears a close resemblance to the zigzag plot lines of his children's books, by turns a cartoonist, ad agency artist (for Flit bug killer), author, caricaturist, documentary-film writer and producer, political cartoonist, and editor. He follows Geisel's life from his childhood in Massachusetts, to his sacking from the editorship of Dartmouth's humor magazine, to the publication of And to Think That I Saw It on Mulberry Street (after 17 rejections), which finally launched him on the career for which he is best known. Given unprecedented access to Dartmouth's extensive Geisel holdings, the author captures Geisel's life in full as he offers fresh insights into the sources of Geisel's creativity, from his surreal images to his anti-authoritarian stance and slapstick humor. The book features many of Dr. Seuss's lesser known illustrations, including college drawings, insecticide ads, and wartime political cartoons, all of which offer a glimpse of his early artistic style and the visual origins of the more famous creatures that later populated his children's books.-- From publisher description and book jacket

Following a previous international conference at the Sapientia Hungarian University of Transylvania in Cluj-Napoca, Romania, and the subsequent publication of a volume of studies with the title Film in the Post-Media Age (Cambridge Scholars Publishing, 2012), which insisted, citing the words of Jacques Rancière, that the ecosystem of contemporary moving images should be understood not as a unified digital environment, but as a highly diversified, ""multisensory milieu,"" another conference was organised, focusing this time directly on the ""multisensory"" nature of moving images. Realism and social science by R. Andrew Sayer( file )
1 edition published in 2000 in English and held by 0 libraries worldwide
Realism and Social Science offers the reader an authoritative and compelling guide to critical realism and its implications for social theory and for the practice of social science. It offers an alternative both to approaches which are overly confident about the possibility of a successful social science and those which are defeatist about any possibility of progress in understanding the social world. Written by one of the leading social theorists in the field, it demonstrates the virtues of critical realism for theory and empirical research in social science, and provides a critical engagement with leading non-realist approaches. Part I provides a guide to the key features of critical realism, illustrated with relevant and accessible examples of empirical research which it has informed. Part II presents a sympathetic critique of postmodernist themes in social science, such as anti-essentialism, social constructionism and the critique of grand narratives. This acknowledges many of the problems raised by postmodernism but offers novel ways of resolving them. Part III addresses issues concerning the role of space in social theory and problems of 'geohistorical explanation'. Part IV assesses arguments that social scientists must necessarily be critical of the societies they study, and presents a case for ending the exclusion of normative theories from social science. Realism and Social Science will be essential reading for anyone interested in the present state of social theory

Islamic finance and law : theory and practice in a globalized world by Maha-Hanaan Balala( file )
1 edition published in 2011 in English and held by 0 libraries worldwide
Islamic commercial and financial practice has not experienced the trial-and-error style of development that has characterised the development that has characterised the development of common law in the English-speaking world. Many of the principles, rules and practices prevalent in the Islamic law of contract, commerce, finance and property remain the same as those outlined by the Quran and the Prophet Muhammad, and expounded by scholars of jurisprudence as far back as the 13th century, despite the advancement in time and sophisticaiton of commercial interaction. Maha-Hanaan Balala here demonstrates how, in order to bridge the gap between the principles outlined by the Quran and the Prophet in the 7th century and commercial practice in the 21st century, Islamic finance jurisdictions need to open themselves to learning from the experience (including the mistakes) of the English common law
