Kennedy complains that Hoffa conducted only cash transactions, failed to maintain business records, claims to remember nothing, and repeatedly refers the committee to other witnesses who then take the 5th Amendment. Kennedy argues that the latter practice is a perversion of the 5th Amendment employed to protect Hoffa. Although Hoffa claims that the Committee is carrying out a vendetta against him, the fact is, in Kennedy's view, that Hoffa has exposed himself to such an inquiry by failing to keep normal business records and by associating with people who, when asked a question, "have to take" the 5th Amendment. Kennedy argues that this multiple use of the 5th Amendment by Hoffa's associates amounts to Hoffa himself taking the 5th Amendment. Edward Bennett Williams, Hoffa's counsel, then questions the legality of inferring guilt from another party's invokation of the 5th Amendment
