According to the author of this commentary, the Human Rights Act will require primary and secondary legislation to be read and given effect in a way which is compatible with rights under the European Convention on Human Rights, and will make it unlawful for public authorities to act in a way which is incompatible with Convention rights. This Comment seeks to make two points: firstly, that special principles of interpretation will apply to the Act as a constitutional document, and that secondly, although the doctrine of margin of appreciation will not apply, the courts applying the Human Rights Act should recognise an analogous doctrine which will accord a discretionary area of judgement in relation to policy decisions which a legislature, executive and public bodies are better placed than the judiciary to decide, in the author's belief.--SCAD summary
