In recent years, president Ramzan Kadyrov has run a so-called virtue campaign in Chechnya. He has made several statements and introduced informal decrees. A so-called 'proper' dress code for women has been one of the pillars of Kadyrov's campaign to strengthen female virtue in Chechnya. This has contributed to a setback for women's independence and their position in society, not least because of the attitudes Kadyrov conveys as a standard to other men. The influence of Adat and also partly the Islamisation of Chechnya during the regime of president Ramzan Kadyrov seems to have worsened the situation for Chechen women. Violence against women is widespread in Chechnya. Domestic violence is a problem. Honour killings still take place and there are reasons to believe that the number of honour killings have increased during the last years. Bride-kidnapping is an old tradition that still occurs. In general very few women seek protection from the authorities after being victims of violence. In the rare cases where women do seek assistance, they do not receive the protection they need. Most marriages are performed by an Imam. Such marriages are not legal under Russian law. However, many register their marriage later for practical reasons. Typically, families agree that a marriage will take place and the young bride and groom are involved to a greater or lesser degree in the decision. The degree of coercion varies. Divorce is not very common in Chechnya. Women in general fear divorce because they know that children traditionally stay with the father and his family after a divorce. Some women bring cases of access rights to court to be able to spend time with their children. Even though some women do win their cases, the decisions are often subsequently ignored

The present comparative analysis examines contemporary asylum flows from Western Balkan (WB) countries of origin (Albania, Bosnia and Herzegovina, the former Yugoslav Republic of Macedonia, Kosovo, Montenegro and Serbia) to EU Member States and Associated Countries (MSACs). In particular, it seeks to: 1. accurately describe the main characteristics of the recent flow of WB citizens applying for international protection in MSACs; 2. examine the principal factors determining decisions by WB citizens to leave their country and apply for asylum in the EU (push factors); 3. examine the factors which affect their choice of destination country (pull factors); 4. look at measures put in place by MSACs to efficiently process applications from WB citizens and other complementary measures. In conclusion, the report attempts to identify the measures which have proved to be the most effective in dealing with large numbers of applications for international protection where many may be unfounded, while ensuring full consideration of each individual claim and protection for those who need it. -- EU Bookshop

This judicial analysis is the product of a project between IARLJ-Europe and EASO and it forms part of the EASO professional development series for members of courts and tribunals. The analysis is primarily intended for use by members of courts and tribunals of EU Member States concerned with hearing appeals or conducting reviews of decisions on applications for international protection. It aims to assist not only those with little or no experience but also those who have more expertise. As such, it aims to be a useful point of reference for all members of courts and tribunals concerned in the hearing of cases or actions to which the CEAS applies. The structure, format, content and design have, therefore, been developed with this broad audience in mind. The analysis is designed to provide an introduction to the CEAS that assists courts and tribunals in the carrying out of their role and responsibilities in its implementation.^It provides: an overview of the legal basis of the CEAS, including a short background to its establishment; an introductory overview of the CEAS legislative instruments; an introduction to the correct approach as a matter of EU law to interpretation of the legislative provisions of the CEAS, including the important topic of when and how to make referral to the CJEU for an interpretative ruling. The analysis is supported by a compilation of jurisprudence and appendices having a specific bearing on the CEAS. They list not only relevant EU primary and secondary legislation and relevant international treaties of universal and regional scope but also essential case-law of the CJEU, the ECtHR and the courts and tribunals of EU Member States. To ensure that the relevant legislation and case-law is easily and quickly accessible to readers, hyperlinks have been utilised.^Other analyses, which have been or are being developed as part of the professional development series, explore specific areas of the CEAS in greater detail. The purpose of this judicial analysis is to put at the disposal of courts and tribunals dealing with international protection cases, a helpful tool for the understanding of protection issues, in this chapter, Article 15(c) of the Qualification Directive (QD). This provision, which by its nature can potentially affect the outcome of many cases dealing with international protection, has not proved easy for judges to apply. Studies show that in different Member States there have been divergent interpretations. The commentary is intended to assist the reader towards an understanding of the QD through the case law of the Court of Justice of the European Union (CJEU) as well as that of the European Court of Human Rights (ECtHR) and relevant decisions of the courts and tribunals of the Member States. Citation of national case law is not exhaustive but intended to be illustrative of the way in which the QD has been transposed and interpreted. The chapter reflects the understanding of the working group on the current state of the law. It must be remembered that Article 15(c) is likely to be subject to further rulings by the CJEU and the reader is reminded of the importance of keeping up to date with such developments. It is assumed that the reader is familiar with the broad structure of the European Union (EU) asylum law as reflected in the EU asylum acquis; the chapter aims to assist not only those with little or no experience of its application to judicial decision-making but also those who are more specialist. This analysis deals with just one limb of Article 15 which contains three categories for persons in need of subsidiary protection who are otherwise not entitled to protection under the Refugee Convention. In due course, further chapters will be produced which examine the other categories which in summary provide for protection from risks comparable to those that breach Articles 2 and 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR)

Becoming acquainted with terminology, local contexts and types of sources, understanding relevant research questions and search terms and obtaining alternative sources of information can better equip a researcher confronted with the difficulties of this topic. This guide aims to provide background knowledge as well as useful tips and sources for researching the situation of LGB in countries of origin. The guide focuses on researching the situation of LGB since transgender and intersex applicants for international protection are not so common. The guide should serve the needs of both experienced and inexperienced COI researchers, as well as caseworkers conducting COI research. Additionally, it may assist lawyers, legal aid providers and judges working in the asylum process. The guide should be consulted in conjunction with EASO's Country of origin information report methodology and the Common EU Guidelines for processing Country of Origin Information (COI), which provide the general framework for COI methodology and quality standards.--
