Activism and self-restraint of the European Court of Human Rights are extreme interpretations of the Convention jeopardizing the European system's balance. However, these excesses are legally valid since the Court's judgement always prevails. Thus, pointing those interpretations as excessive does not mean that they are false but that they modify the legal relationship between the Court and the States parties. The European system acknowledges the Court's interpretative competence while leaving to the States freedom of appreciation. These two legal forces are mutually determined and interact in every case before the Court. By overstepping its competence, the Court demonstrates its activism which disadvantages States parties in their freedom of appreciation. On the contrary, leaving to States extreme freedom, the Court agrees to limit its competence which leads to self-restraint. Without exercising any moral judgement, our analysis of the Court's excesses does not concentrate on the effectiveness of its protection of human rights but on the respect by the Court of its fundamental relationship with States parties. This relationship constitutes an interpretative frame meant to determine European Court conditions. This relationship is also powerful since, controlling its relationship with the States, the Court chooses between activism or self-restraint. The activist or self-restrained case law can be distinguished from the general case law. From this specific case law can be inferred how and why the Court decides activism or self-restraint

"This 'Liber Amicorum' to Dean Spielmann contains contributions of more than 70 highly esteemed human rights lawyers. The contributions in the book mostly consider developments on Article 8 of the European Convention on Human Rights. The book is to honor the work of Dean Spielmann as lawyer, judge and later as president of the European Court of Human Rights. After graduating from the prestigious universities of Louvain and Cambridge, Dean Spielmann took up the practice of the law, at which he excelled, until his election as a judge of the Court in 2004. He was elected President of a Section in 2011 and Vice-President in 2012, becoming the President of the Court later that same year. During his term of office, he has developed relations with both supreme courts and other international courts and contributed to the Strasbourg Court's high standing in the world, far beyond the continent of Europe. A man of dialogue, he has been from the outset an ardent advocate of Protocol No. 16 to the European Convention on Human Rights, which he has dubbed the Protocol of dialogue. This book brings together contributions from judges and former judges, at national and international level, from academics and from officials of the Court's Registry, who wished to show their admiration and friendship for him. For more interesting articles on the development of the European Court of Human Rights we also want to mention the 'Freedom of Expression' Liber Amicorum for Nicolas Bratza which was published by our company 3 years ago.
