El derecho de obligaciones español es una forma muy antigua del derecho de obligaciones germánico. El intento, de introducir en él los perfilamientos romanos, se logró en la ley de los visigodos tan escasamente como hubo de lograrse con respecto a otras materias. La pronta y violenta invasión árabe, hizo arraigar durante muchos siglos en los territorios del Norte que permanecieron libres, las primitivas instituciones góticas tal y como ellas regían antes de la conquista; por eso el derecho español de los siglos XII y XIII, supera en el mantenimiento de la primitiva originalidad a los otros derechos germánicos de este tiempo --incluso al escandinavo, con el cual, sin embargo, aparece emparentado estrechamente. Las fuentes cuyo examen es necesario apurar, proceden, en lo esencial, del Norte de España y de Portugal. El hecho de que ellas solo hayan sido editadas hasta hoy de manera insuficiente, dificulta la investigación, pero no puede detener su comienzo.
