Les contrats entre personnes morales de droit public ont connu un fort développement au cours des vingt dernières années. Ils interviennent désormais dans les domaines les plus divers. Pris en tant qu'objet d'étude autonome, ils présentent assez d'unité pour que l'on puisse en élaborer une théorie générale. Qu'ils soient de nature administrative ou privée, les sources du droit qui les régit - marquées par l'importance des sources écrites - présentent de fortes similitudes. Parce que ce sont des contrats, c'est-à-dire des accords de volontés générateurs d'obligations selon une définition commune aux droits public et privé, les principes de force obligatoire et d'effet relatif posés par le code civil leur sont applicables. Leur régime est toutefois marqué par la différence de situation entre les parties à l'acte, ce qui les rapproche des contrats administratifs. L'une de ces parties, celle qui a la responsabilité principale du service, disposera des pouvoirs d'intervention traditionnellement reconnus à l'administration lorsque le contrat lie une personne publique et une personne privée. Parce que les données d'intérêt général demeurent présentes, les théories de l'imprévision et du fait du prince pourront être mises en œuvre. Les contrats entre entités publiques diffèrent cependant des contrats administratifs par le fait que le juge administratif du contrat accepte de tenir un rôle plus actif au cours de la phase d'exécution (mais il n'est que rarement saisi). En outre, leur particularité est de porter sur les compétences des personnes publiques - leurs clauses ne présentent toutefois pas entre les parties un caractère règlementaire - qui s'en servent pour modifier, parfois sans investiture spécifique, l'ordre légal de ces compétences. ce qui est d'autant plus remarquable que les compétences ne sont pas des droits subjectifs dont les collectivités publiques peuvent disposer à leur gré. Les contrats entre personnes publiques apparaissent ainsi comme un des outils essentiels de réforme de notre système public.

Contracts between public bodies have undergone a sizeable expansion during the past twenty years. They now deal with a great range of areas. as a separate field of study, they offer enough unity to allow for the elaboration of their general theory. Whether administrative or private, the sources of the law governing these contracts - written sources being particularly important - show great similarities. being contracts i.e. according to a definition common to both administrative and private law, a meeting of the minds creating a legally enforceable agreement, they are also subject to the principles of binding effect and privity of contracts as stated in the civil code. However, their system is marked out by the difference in the situation between the contracting parties which brings these contracts closer to administrative ones. The party which takes on the major responsibility to provide a service will be granted the enforcement powers commonly vested in a public body whenever a contract links it with a private one. Since general public interest is still at stake, the doctrines of frustration and fait du prince are applicable to them. Nevertheless, contracts between public entities differ from administrative contracts in that the administrative judge of contracts agrees to play a more active role during the performance stage (although he is seldom referred to). Moreover, despite the fact that between the parties, the terms of the contract are not of a regulatory nature, the characteristic of these contracts is to deal with the powers of public institutions which sometimes use them to modify the legal order of their powers, without any specific authority to do so. This is even more remarkable since public institutions' powers cannot be considered as subjective rights at the free disposal of these institutions. Contracts between public institutions are therefore appearing as one of the essential tool to improve our public system.
