Abstract:
While the Code of criminal procedure offers the Public prosecutor's office a range of prosecution options, immediate appearance has gradually emerged as the new figurehead of the real-time offence processing service. An emergency procedure that is particularly controversial because of the particularly high rates of committal orders, it is as much the object of strong criticism from legal professionals as it is of a defense from actors who point out that it would be reserved only for simple offences, which are ready to be judged and for which celerity is necessary in the interest of the proper administration of justice and to ensure the dissuasive effect of the criminal sanction. Based on quantitative methods derived from modelling and machine learning work, and semi-directive interviews with legal professionals, whether magistrates, lawyers or teacher-researchers, this thesis measures the gap between theoretical criminal law and its practice. Extending and surpassing existing research, we demonstrate the impact, on the pronouncement of a committal order, of non-legal elements that the judicial operation takes care of bringing into the penal loop. This procedure thus constitutes above all a tool for managing the flow of a particularly precarious criminal clientele: young, foreign, isolated, low-income, homeless men, who sometimes present a deteriorated state of health. The weight of these social markers of marginality thus testifies to the role played by criminal justice in our contemporary society. The immediate appearance procedure is not simply a means of legal prosecution, it is also, and perhaps above all, a repressive response to social problems.
