Abstract:

This volume is a redaction of three nearly identical manuscripts, one in the Lincoln's Inn Library catalogued as Hill 80, a second in the Harvard Law School Library catalogued as MS. 1086, and a third in the Parker Manuscripts in the Lilly Library at Indiana University, Bloomington, catalogued as LMC 1673. All three of the manuscript bound volumes upon which the edited text appearing in this volume is based bear labels or annotation implying, in one way or another, an attribution to the chief justice of the Court of Common Pleas, and later lord chancellor, Peter King. This volume is entitled "Reports of Sir Peter King" accordingly. The following discussion begins by considering the three manuscripts themselves, and their individual quirks; the relationships amongst the three manuscripts; their potential relationship, so far as can be deduced, to original source material from which they may ultimately derive; whether one may definitively conclude that the manuscripts contain material of which King was the original author; and whether one may rightly regard their contents as 'law reports' as usually understood. A brief biography of the manuscripts' central figure, Peter King, is also provided. Thereafter, in an effort to determine the ultimate design that its author may have had for the manuscripts' contents, an analysis follows of the cases by original writ, subject matter, and stage of proceeding noted in the entries. Finally, the introduction turns to a consideration of cases that are of particular legal historical interest by topic, providing a discussion of the law that can be deduced from a study of the manuscripts' entries. - p.xv.
