Phénomène répandu, mais mal connu, la rétroactivité consiste à retraiter au présent les effets de droit produits dans le passé. Alors même qu'elle porte atteinte aux situations antérieurement constituées, la rétroactivité connaît des applications nombreuses et disparates en droit public. L'utilisation qu'en font le législateur, l'autorité administrative et le juge obéit à une logique propre à chacun d'eux. Cette disparité se traduit à la fois dans les mécanismes mis en oeuvre et dans les contraintes qui pèsent respectivement sur les acteurs de la rétroactivité. Le polymorphisme du phénomène n'empêche pas de réaliser une théorie générale de la rétroactivité. La notion de rétroactivité, ainsi que la fonction qu'elle est appelée à remplir au sein de l'ordre juridique, présentent une cohérence suffisante pour faire l'objet d'une analyse unitaire. D'abord, la rétroactivité se définit comme l'opération par laquelle l'entrée en vigueur de la norme juridique est anticipée dans le temps. L'action dans le temps des normes juridiques étant fonction de leur structure logique, cette dernière est également un élément constitutif de la notion de rétroactivité. Ensuite, la rétroactivité offre un cadre normatif au sein duquel les effets de droit produits dans le passé vont être retraités en vue d'obtenir un résultat déterminé. La rétroactivité permet à l'autorité publique de réaliser plusieurs opérations normatives sur le passé de l'ordonnancement juridique au cours d'une période déterminée, dite « période intermédiaire ». Ainsi comprise, la rétroactivité assure une triple fonction d'unification, de correction et de stabilisation des effets survenus au cours de cette période intermédiaire.

Spread phenomenon, but not well known, retroactivity consists in reprocessing at the present legal effects, which have occurred in the past. While at the same time it undermines the situations previously set up, retroactivity knows many and disparate applications in public law. The use that the legislator, the administrative authority and the judge make of it obeys a logic that is peculiar to each one of them. This disparity is conveyed both in the mechanisms implemented and the constraints weighing respectively on the actors of retroactivity. The polymorphism of the phenomenon does not prevent from carrying out a general theory of retroactivity. Concept of retroactivity, as well as the function which it carries out within the legal order, present a sufficient coherence to be the subject of a common analysis. First, retroactivity can be defined as the operation by which the entry into force of legal norms is anticipated in time. The action in time of the legal norms being related to their logical structure, the latter is also a component of the concept of retroactivity. Second, retroactivity offers a normative framework in which legal effects, which occurred in the past, will be reprocessed in order to obtain a given result. Retroactivity makes it possible for the public authority to carry out several normative operations on the past of the legal order during one determined period, called “intermediate period”. Thus understood, retroactivity ensures a triple function of unification, correction and stabilization of the legal effects which have occurred during this intermediate period.
