Abstract:

This paper examines the process of evaluation of Supreme Court nominees. The paper states that the evaluation of the nominee should be based on the recognition that Supreme Court adjudication inevitably requires choice and discretion but that the exercise of such choice or discretion must be cabined by the constraints traditionally imposed by the judicial process. The paper examines how this bears on the evaluation of Supreme Court nominees, and challenges the myths and slogans that have served to confuse that process and mislead the American public.
